SERVICE PROVISION AGREEMENT

The following contains the general terms and conditions of contract under which, TRT Express Services, LLC (TRT) is engaged in the transportation of Parcel shipments, Air freight, Warehousing and USA distribution itself and jointly through interchange with its partners, and authorized representatives.  The Sender acknowledges that Parcels will be consolidated with those of other Senders for transport.

Delivery time estimates for Parcel shipments, Air Freight are good faith estimates and shall not be considered as strictly defined.  Delivery time estimates may differ from those specified in the transport document or on the Website and shall not include:  a day of transfer of the Package shipment for carriage; weekends; official holidays; days on which banking institutions are closed; periods of delays related to a shipment’s security check; times of customs clearance of shipments; delays caused by the circumstances beyond TRT control.

Parcels Customs Clearance. If customs clearance requires the provision of additional documents or payment of customs duties by the Recipient for the purpose of Parcel customs clearance in the country of destination, TRT or its partner shall contact the Recipient to obtain the required documents. If the Recipient refuses to provide documents or pay the costs related to customs clearance within 10 calendar days upon the arrival of the Parcel, or if there is no contact with the Recipient within 10 calendar days, then the Sender shall contact the Recipient to obtain the required documents. If there is still no contact with the Recipient, TRT will return the Parcel to the Sender in the country of dispatch at the Sender’s expense.

Limitation of Liability. The maximum limited liability for TRT Express Services international small parcel shipping is up to $60.00 for each parcel. Additional insurance is available at $5 per $100 of commercial value. International shipping claims for concealed loss, visible or concealed damage, or missing contents must be reported within 15 calendar days and filed within 6 months of the shipment date. The limitation of liability of TRT shall be applicable from the making of this contract of carriage until the Parcel is delivered to the Recipient at the destination, Partner’s pick-up point or equivalent. The liability of the Parties shall be regulated by the Terms of Service of this Agreement available at https://trtexpress.com.  

TRT shall not be liable or responsible for the loss or damage which occurred or arose prior to or after the course of transportation by TRT or its partners, loss or damage resulting from improper, inadequate or unsafe packaging, loss or damage to Perishable Commodities, loss or damage due to acts of God, natural disasters, war risks, acts of terrorism, nuclear damage, acts of public authorities, acts or omissions of customs or similar authorities, authority of law, the application of security regulations imposed by the government or otherwise applicable to the Parcel shipment, riots, strikes or other labor disputes, civil unrest, disruptions in national or local air or ground trans­portation networks,  loss or damage to any Parcel shipment for which TRT has no scan or other record reflecting that the Parcel or Shipment was tendered to TRT.

Insurance. Additional Insurance for Parcel shipments is available from TRT at the rate of $5 per $100.00 value or part thereof, over the first $60.00 value. Such additional insurance covers loss, full or partial, for which TRT may be liable to a maximum of $1000.

The Sender agrees to indemnify, defend, and hold harmless TRT and its affiliated companies, their officers, directors, employees, partners, authorized representatives from all claims, demands, expenses, liabilities, causes of action, enforcement procedures, and suits of any kind or nature brought arising from or relating to a Parcel shipment or Cargo shipment in violation of applicable law or regulation.

The Sender acknowledges having confirmed with TRT that it is the Sender’s obligation:

1. to establish the applicable customs rules of the country of destination, to determine whether any duties and taxes are applicable when the parcel arrives,
2. to establish a time frame for delivery of the Parcel to the country of destination during holiday season, during Christmas and Easter seasons,
3. to pay all duties and taxes relating to the content of the parcel. The Sender acknowledges that duties and taxes are applied by the country of destination of the Parcel.

Articles Prohibited for Transportation. No service shall be rendered in the transportation of any of the prohibited articles and Hazardous Materials, defined as those materials regulated under Title 49 of the

Code of Federal Regulations (49 C.F.R.)  listed on TRT website https://trtexpress.com.

Charges. TRT reserves the right to bill for Charges based upon the characteristics of, and services requested for, Parcel shipments tendered to TRT. TRT also reserves the right to audit any Parcel, Shipment and/or invoice to verify service selection, dimensions, or weight, and applicability of any Charges.

Claims Procedure. The Carrier shall not be liable for the loss of the package, damage or missing content unless the Sender or the Recipient reports the loss to TRT. Notice of a claim must be given in writing within fifteen (15) days from delivery date in case of damage or partial content loss and within (90) days from the shipping date via email in case of a package loss: support@trtexpress.com; by mail or personal delivery to TRT at 250 Port Street, Newark, NJ 07114. The claim should include a clear and limited statement of the nature of the claim, Parcel shipment number and content value. Items such as receipts, invoices and purchase orders can help identify merchandise. Attaching photos of damaged packages is required for damage claims.

Applicable Law. This contract shall be interpreted and governed by the laws of the State of New Jersey
